1. Agreement to Terms

By accessing and using ThumbsWise ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on ThumbsWise for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on the Service
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server
• Violate any applicable laws or regulations
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Obtain or attempt to obtain any materials or information through any means not intentionally made available

The materials on ThumbsWise are provided on an "as is" basis. ThumbsWise makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

In no event shall ThumbsWise or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on ThumbsWise, even if ThumbsWise or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on ThumbsWise could include technical, typographical, or photographic errors. ThumbsWise does not warrant that any of the materials on the Service are accurate, complete, or current. ThumbsWise may make changes to the materials contained on the Service at any time without notice.

• Use the Service for any illegal purpose or in violation of any applicable laws
• Harass, abuse, or threaten other users or ThumbsWise staff
• Upload content that infringes on intellectual property rights

• Attempt to gain unauthorized access to the Service or its systems
• Scrape, crawl, or automatically collect data from the Service
• Interfere with or disrupt the Service or servers connected to it
• Engage in spam, phishing, or social engineering
• Use the Service to compete with ThumbsWise or create a similar service

ThumbsWise respects intellectual property rights. If you believe your content has been infringed, please contact us at [email protected] with:

• A description of the copyrighted work or trademark
• The location of the infringing material
• Your contact information and statement of good faith belief

We will investigate and take appropriate action, including removal of infringing content.

11. YouTube Data API Compliance

ThumbsWise uses YouTube Data API v3 to fetch public channel and video information. You agree to:

• Comply with YouTube's Terms of Service
• Not use YouTube data for purposes other than thumbnail preview and comparison
• Not redistribute or sell YouTube data
• Respect YouTube's API quota and rate limits
• Not attempt to circumvent YouTube's authentication or authorization mechanisms

12. Pricing and Payments

ThumbsWise offers subscription plans at the prices listed on our pricing page. By subscribing, you agree to:

• Pay all charges incurred under your account
• Authorize recurring billing for subscription renewals
• Notify us of any billing issues or disputes
• Accept price changes with 30 days' notice

Refunds are available within 7 days of your initial purchase. After 7 days, all payments are non-refundable except as required by law. You may cancel your subscription at any time, and it will remain active until the end of your current billing period. For details on our refund policy, please see our Refund Policy page.

13. Termination

ThumbsWise may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if you breach the Terms of Service.

Upon termination, your right to use the Service will immediately cease. We may delete your account data after a reasonable period, unless required to retain it by law.

14. Limitation of Liability

In no event shall ThumbsWise, its directors, employees, or agents be liable to you for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, even if ThumbsWise has been advised of the possibility of such damages.

15. Indemnification

You agree to indemnify and hold harmless ThumbsWise and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Service
• Your violation of these Terms of Service
• Your violation of any applicable law or regulation
• Content you upload or share
• Your infringement of any third-party intellectual property rights

16. Governing Law

These Terms of Service and all related policies are governed by and construed in accordance with the laws of the Republic of Turkey. You irrevocably submit to the exclusive jurisdiction of the Istanbul Çağlayan Courts for any disputes arising from or relating to these Terms of Service or your use of the Service.

17. Changes to Terms

ThumbsWise reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

18. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
